Terms of Business
Provision of Traineeship/New Apprenticeship Services
Acceptance of our proposal to deliver training and assessment services or the signing of a National Apprenticeship/Traineeship Training Plan- SUMMARY document, nominating Ashley Institute of Training as the Registered Training Organisation (RTO), infers acceptance of these Terms of Business.
Definition Clause:
* The employer is the employer as nominated on the National Apprenticeship/Traineeship Training Plan-SUMMARY document or the Apprenticeship/Traineeship Training Contract.
* The RTO is Ashley Institute of Training (AIT), ABN 76 060 542 789 .
Responsibilities of The RTO under the Terms of Business:
Offer an Application for Recognition of Current Competence to each Trainee in order to minimize the incidence of training duplication.
Provide training for each competency where required.
Assist The Employer to deliver training where required.
Provide the Trainee, where required, with Learning Materials for each competency.
Assist with any paperwork required to access the Traineeship Program.
Provide a certificate to each Trainee that successfully completes the qualification.
Responsibilities of The Employer under the Terms of Business:
* Will allow The RTO workplace Trainer access to the Trainee(s) for the purposes of training and assessment.
* Will provide a safe working environment.
* Will provide appropriate time, tools and equipment to enable learning and training and assessment of the units in the traineeship.
* Will assist the Trainee to achieve the competencies contained in the certificate.
Payments to The RTO
Unless otherwise stated in a written agreement the terms of payment are:
The Employer agrees to pay The RTO for the Trainees subject to the Terms of Business, in the following manner:
* $500 on the commencement of the traineeship.
* $1000 three months after the commencement of the traineeship.
* $500 on the first yearly anniversary of the commencement of the traineeship.
* $1000 on completion of the traineeship.
All payments are due to The RTO within seven (7) days of receipt of the invoice. (NOTE: Payments to The RTO are for the provision of accredited Education and Training and, therefore, do not incur Goods and Services Tax.)
Cancellations:
Where the Employee leaves the employ of The Employer at anytime after enrolling in the course, The Employer shall not be liable for a cancellation fee for that Employee.
If The Employer cancels the Traineeship of an Employee with The RTO within the first three months from the commencement of the traineeship, The Employer shall be liable for $500 on the commencement of the traineeship and a further cancellation fee of $500.
If The Employer cancels the Traineeship of an Employee with The RTO after the first three months from commencement of the traineeship for that Employee, The Employer shall be liable for the $500 fee on the commencement of the traineeship, the $1000 payment at 3 months from the commencement date and a cancellation fee of $500.00 for that Employee.
If The Employer changes RTO’s during the training of an Employee at any time during the Traineeship, The Employer shall be liable to pay The RTO its full entitlement fees as per these Terms of Business and as described above including the next payment due to The RTO had the training of the Employee continued."
Privacy:
The RTO Agrees to adhere to all standard privacy conventions and treat all information supplied to The RTO by The Employer about itself or its Employees private and use such information for training purposes and administrative requirements only.
Assignment:
This agreement is assignable in part or full by The RTO.
Changes to Terms of Business:
Any changes to these Terms of Business must be in writing.
